Professional Conduct Review Disciplinary Findings

NOTICE TO NURSES AND PUBLIC

The following decisions of the Professional Conduct Review/Disciplinary Committee of the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) are published in the interest of protecting the public and enhancing awareness of the importance of adherence to standards of practice and code of ethics for nurses in the province of Newfoundland and Labrador.


Seanna Maher
Newfoundland and Labrador Registration No. 18288
In the matter of a Complaint against Seanna Maher (the “Respondent”), Registrant # 18288, and a hearing of the Complaint pursuant to Section 25 of the Registered Nurses Act, 2008 (the “Act”); an Adjudication Tribunal of the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) in a Decision dated March 25, 2013 found the Respondent guilty of conduct deserving of sanction pursuant to the Act, in particular, the following sections:

18 (c)(i) professional misconduct, and 18 (c)(v) acting in breach of the Code of Ethics, in that the Respondent tampered with a medication, such that she replaced the medication Lorazepam with a high concentration of Acetaminophen; and

18 (c)(i) professional misconduct, and 18 (c)(v) acting in breach of the Code of Ethics, in that the Respondent placed a patient at risk of serious harm, having tampered with a medication, by replacing Lorazepam with a high concentration of Acetaminophen.

The conduct deserving of sanction occurred on July 5, 2011 while the Respondent practiced as a registered nurse at the Janeway Children’s Health and Rehabilitation Centre in St. John’s, Newfoundland and Labrador. The Complainants were Eastern Health and a registered nurse.

Pursuant to section 28(3) of the Act, the Adjudication Tribunal ordered suspension of the Respondent’s license for six months effective from October 27, 2012. Following the period of suspension the Respondent is prohibited from acquiring a license to practice nursing in the province of Newfoundland and Labrador until the following terms and conditions are met to the satisfaction of the ARNNL:

(i)  The Respondent shall provide a supportive health assessment  addressing her health in relation to her  ability to practice as a registered nurse;
(ii) The Respondent shall provide a report from her family physician regarding her wellness to return to the practice of nursing;
(iii) The Respondent shall  successfully complete the Canadian Nurses Association’s learning module on the Code of Ethics for Registered Nurses;
(iv) The Respondent shall successfully complete the Jurisprudence module through the Continuing Nursing Education Portal at Practice NL;
(v) The Respondent shall successfully complete a paper referencing the Code of Ethics for Registered Nurses and how her conduct violated the Code with particular attention to the honesty and integrity of registered nurses;
(vi) The Respondent shall  satisfactory complete a Nursing Re-entry program, if required, based on the outcomes of the medical assessments; and
(vii) The Respondent shall continue ongoing counseling, as required, with a health care professional, and provide periodic reports, to the Director of Professional Conduct Review, regarding her health status.

The Adjudication Tribunal ordered that the Respondent pay a contribution towards the costs of the ARNNL for its investigation and the hearing of the complaint in the amount of $6,000. The Adjudication Tribunal further ordered that the Registrant shall be permitted to pay this amount by installments.

Margo Bishop (Edwards)
Newfoundland and Labrador Registration No. 17623
On  May 3, 2013, Margo Bishop (Edwards) met the terms of the Order of the Adjudication Tribunal, dated February 11, 2011, such that she is no longer prohibited from acquiring a practicing license to practice in the province. On May, 8 2013 her license was reinstated with terms as ordered by the Adjudication Tribunal.

Elizabeth Penney
Newfoundland and Labrador Registration  No. 14273
On February 8, 2013, the ARNNL Council suspended the practicing license of Elizabeth Penney pending a hearing of the adjudication tribunal of the disciplinary panel.

Seanna Maher
Newfoundland and Labrador Registration No. 18288
On October 27, 2012, the ARNNL Council suspended the practicing license of Seanna Maher pending a hearing of the adjudication tribunal of the disciplinary panel.

Paulette Kean
Newfoundland and Labrador Registration No. 16710

In the matter of a Complaint against Paulette Kean (the “Respondent”), Registration # 16710, and a hearing of the Complaint pursuant to Section 25 of the Registered Nurses Act, 2008 (the “Act”); an Adjudication Tribunal of the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) in a Decision dated July 25, 2012 found the Respondent guilty of conduct deserving of sanction pursuant to the Act, in particular, the following sections:
 
18 (c)(i) professional misconduct and/or 18 (c)(ii) professional incompetence, in that on multiple occasions the Respondent’s practice with respect to the administration, documentation, handling and discard of narcotic medication failed to meet proper medication standards, documentation standards and organization policies for safe medication administration; and

18 (c)(i) professional misconduct, in that the Registrant’s behaviour with respect to the administration, documentation, storage and handling of narcotics demonstrated a pattern indicative of misappropriation of narcotics.
 
The conduct deserving of sanction occurred from on or about December 30, 2008 to on or about November 19, 2009 while the Respondent practiced in Brookfield, Newfoundland and Labrador.

On November 9, 2012 pursuant to Section 28 (3) of the Registered Nurses Act, 2008, the Adjudication Tribunal ordered the following:

(a) that the Respondent surrender her license to ARNNL Council;
(b) that the Respondent’s name be struck from the ARNNL register; and
(c) that the Respondent pay a part of the costs of the ARNNL in the investigation and hearing of this matter in the amount of $9,475.61.

Katherine Richards
Newfoundland and Labrador Registration No. 14077

The Adjudication Tribunal in a Decision dated, April 27, 2012 found the Registrant guilty of conduct deserving of sanction pursuant to the Act, in particular, section18(c)(i) professional misconduct, 18(c)(ii) professional incompetence, 18(c)(iii) conduct unbecoming a registered nurse, 18(c)(iv) incapacity or unfitness to engage in the practice of nursing and 18(c)(v) acting in breach of the code of ethics.

The Adjudication Tribunal ordered the Registrant’s license remain suspended until such time as she can demonstrate to an Adjudication Tribunal that she can safely return to nursing practice.

Mary Sloan
Newfoundland and Labrador Registration No. 5885

On June 12, 2012, Mary Sloan met the terms of the Order of the Adjudication Tribunal, dated January 16, 2012, such that the restriction on her practicing license has been removed.  There is no longer a restriction on the Registrant's practicing license with ARNNL.

Fay Wheeler
Newfoundland and Labrador Registration No. 6894

In the matter of an Application made by the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) and a  Complaint against Fay Wheeler (the “Respondent”), Registration # 6894, and a hearing of the Application and Complaint pursuant to Sections 25 and 31 of the Registered Nurses Act, 2008 (the “Act”); an Adjudication Tribunal of the  (ARNNL) in a Decision dated March 8, 2012 found the Respondent guilty of conduct deserving of sanction pursuant to the Act, in particular, the following sections:

18 (c )(iii) conduct unbecoming a Registered Nurse, in that the Respondent failed to comply with a previous order of an Adjudication Tribunal; and

18(c)(iii) conduct unbecoming a Registered Nurse, and 18 (c )(v) acting in breach of the code of ethics, in that the Respondent was dishonest in her dealings with both her employer and the ARNNL.

The conduct deserving of sanction occurred during the period of November 18, 2009; while the Respondent practiced in St. Anthony, Newfoundland and Labrador, and May, July and August 2010. The Complainant was Labrador-Grenfell Health and the ARNNL.

Pursuant to section 28(3) of the Act, the Adjudication Tribunal ordered the following:

1) The Respondent’s license remain suspended until she completes conditions summarized as follows:
    (i) submits to the ARNNL negative random blood toxicology screens over four consecutive month period;
    (ii) successfully completes learning modules in professional responsibilities, jurisprudence and  ethics;
    (iii) successfully completes a paper on the code of ethics and other subject matter specified in the order; and

2) The Respondent shall, following the return of her nursing license and her return to nursing practice, provide an additional four negative blood toxicology screens over a 12 month period.

3) The Respondent shall provide a copy of the Order of the Adjudication Tribunal to any future employer and shall further provide written confirmation from any future employer to the Director of Professional Conduct Review that she has complied with this provision of the Order.

The Adjudication Tribunal ordered the Respondent responsible for the partial costs of the ARNNL in its investigation and the hearing of the Application and Complaint in the amount of $12,500.

Mary Sloan
Newfoundland and Labrador Registration No. 5885

On March 12, 2012, the practicing license of Mary Sloan was reinstated with restriction.  The Registrant shall not work in Long Term Care, Home Care or Community Health.  The restriction on the Registrant's license shall be removed upon her successful completion of the courses set out in the Order of the Adjudication Tribunal dated January 16, 2012.

Mary Sloan
Newfoundland and Labrador Registration No. 5885


In the matter of a Complaint against Mary Sloan (the “Respondent”), Registration # 5885, and a hearing of the Complaint pursuant to Section 25 of the Registered Nurses Act, 2008 (the “Act”); an Adjudication Tribunal of the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) in a Decision dated January 16, 2012 found the Respondent guilty of conduct deserving of sanction pursuant to the Act, in particular, the following section:

18 (c )(i) Professional misconduct, in that the Respondent spoke inappropriately to a patient forcing the patient to leave her room when unwell;

18 (c )(i) Professional misconduct and 18 (c )(ii) professional incompetence, in that the Respondent failed to properly administer an insulin injection; failed to communicate and provide support to staff members, and failed to communicate with patients;  presented in a cold and insensitive manner, and failed to communicate with a family when administering a medication to a patient; spoke loudly to a patient’s family member and communicated inaccurate information with regards to the patient; and shared personal information with a family member;

18 (c )(ii) Professional incompetence, in that the Respondent administered oxygen at an incorrect flow rate and left a used capped syringe at a patient’s bedside.

The conduct deserving of sanction occurred during the period of March 2, 2008 and February 2, 2009 while the Respondent practiced in St. John’s, Newfoundland and Labrador. The Complainant was Eastern Health.

Pursuant to section 28(3) of the Act, the Adjudication Tribunal ordered that the Respondent’s license be suspended for a five month period, effective October 11, 2011, with terms and conditions summarized as follows:

(i) The Respondent’s license to practice nursing shall be restricted such that she shall not work in Long Term Care, Home Care or Community Health; and

(ii) The restriction on the respondent’s license shall be removed upon her successful completion of the following courses: Interpersonal Aspects of Nursing and Professional Responsibility.

The Adjudication Tribunal reserved on the question of costs and a separate decision will be issued in relation to costs.


Brian Budden
Newfoundland and Labrador Registration No. 16605

In the matter of a Complaint against Brian Budden (the “Respondent”), Registration # 16605, and a hearing of the Complaint pursuant to Section 25 of the Registered Nurses Act, 2008 (the “Act”); an Adjudication Tribunal of the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) in a Decision dated November 4, 2011 found the Respondent guilty of conduct deserving of sanction pursuant to the Act, in particular, the following sections:

i. 18 (c)(i) professional misconduct, 18 (c)(ii) professional incompetence, and 18 (c)(v) acting in breach of the Nurse Practitioner Regulations, in that on multiple occasions the Respondent  prescribed medications that were unauthorized for Nurse Practitioner Practice under the Registered Nurses Act, Nurse Practitioner Regulations (1998) or (2009).

ii. 18 (c)(i) professional misconduct, 18 (c)(ii) professional incompetence, and 18 (c)(v) acting in breach of the Nurse Practitioner Regulations, in that on multiple occasions the Respondent prescribed medications that were not authorized under the Controlled Drugs and Substances Act (1996).

The conduct deserving of sanction occurred during the period of November 12, 2008 and November 17, 2009 while the Respondent practiced in St. John’s, Newfoundland and Labrador.

Pursuant to section 28(3) of the Act, the Adjudication Tribunal ordered suspension of the Registrant’s Registered Nurse License and Nurse Practitioner License for a one- month period, effective October 21, 2011 subject to terms and conditions summarized as follows:

i. The return of the Respondent’s Registered Nurse License shall be conditional upon the Respondent preparing and presenting a written and oral presentation to ARNNL’s Nursing Consultant - Regulatory Services and Advanced Practice demonstrating that the Respondent has knowledge and understanding of the scope of Nurse Practitioner practice.

ii. The return of the Respondent’s Nurse Practitioner License shall be conditional upon:
a) the Respondent arranging with his employer for the ARNNL to conduct periodic chart audits for a period of one year;

b) the Respondent  arranging a meeting with a representative from ARNNL, his employer, his collaborating physician as well as others specified in the Order to review the Registrant’s practice concerns giving rise to the Complaint, and

c) ARNNL’s Nursing Consultant - Regulatory Services and Advanced Practice being satisfied that the Respondent fully understands the scope of his Nurse Practitioner practice.

The Adjudication Tribunal further ordered the Respondent to successfully complete the following courses:

i. “ Roles of Nurse Practitioners in Primary Health Care” at Memorial University; and
ii.  “Documentation in Nursing” at Grant MacEwan University, Centre for Professional Nursing Education.

The Respondent’s failure to successfully complete the courses or failure to enroll in the courses (or alternate courses as designated by ARNNL) shall constitute a breach of the Order of the Adjudication Tribunal.

The Adjudication Tribunal ordered that the Respondent pay costs to ARNNL in the amount of $4,200.


Brian Budden
Newfoundland and Labrador Registration No. 16605

On December 1, 2011 Brian Budden met conditions of the Order of an Adjudication Tribunal of the ARNNL Disciplinary Panel dated November 4, 2011 such that his Registered Nurse License and Nurse Practitioner License were reinstated. The Registrant’s NP license is conditional to the remainder of the requirements set out in the Order.

Colleen Petten
Newfoundland and Labrador Registration No. 17402

In the matter of a Complaint against Colleen Petten (the “Respondent”), ARNNL # 17402, and a hearing of the Complaint pursuant to Section 25 of the Registered Nurses Act, 2008 (the “Act”); an Adjudication Tribunal of the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) in a Decision dated September 23, 2011 found the Respondent guilty of conduct deserving of sanction pursuant to the Act, in particular, the following section:

18 (c )(ii) Professional incompetence, in that the Respondent, failed to accurately assess a  patient, consult a physician and discontinue administration of a medication.

The conduct deserving of sanction occurred during the period of September 13 to September 14, 2009 while the Respondent practiced in St. John’s, Newfoundland and Labrador. The Complainant was Eastern Health.

Pursuant to section 28(3) of the Act, the Adjudication Tribunal ordered that the Respondent:
(i)  Attend all in-service education sessions regarding fetal surveillance monitoring offered by her employer for a period of one year;
(ii) Participate in an individual education session dealing with fetal surveillance monitoring within four months;
(iii) Complete the Obstetrics and Documentation Modules at the Centre for Nursing Studies within four months;
(iv) Provide ARNNL reports from her supervisor regarding her adherence to policies/practice in relation to fetal surveillance monitoring for a period of one year;
(v) Work the number of shifts required by her employer to ensure nursing competency.

In the event the Respondent fails to comply with any of the conditions of the Order of the Adjudication Tribunal, the Respondent‘s license to practice nursing shall be suspended pending a hearing of the matter.

The Adjudication Tribunal ordered that the Respondent pay a contribution towards the costs of the tribunal hearings in the amount of $2,000.

James Peddle
Newfoundland and Labrador Registration No. 18554

In the matter of a Complaint against James Peddle (the “Respondent”), ARNNL # 18554, and a hearing of the Complaint pursuant to Section 25 of the Registered Nurses Act, 2008 (the “Act”); an Adjudication Tribunal of the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) in a Decision dated February 22, 2011 found the Respondent guilty of conduct deserving of sanction pursuant to the Act, in particular, section 18(c)

(i) Professional Misconduct, in that the Respondent demonstrated dishonesty by misappropriating narcotics from his employer and fraudulently documenting the administration of the narcotics on the narcotic control sheets.

The conduct deserving of sanction occurred during the period of May 15, 2009 to August 18, 2009 while the Respondent practiced in Corner Brook, Newfoundland and Labrador. The Complainant was Western Health.

Pursuant to section 28 (3) of the Act, the Adjudication Tribunal ordered suspension of the Registrant’s license to practice nursing for a period of six months effective December 9, 2010. Following the six months, the suspension shall continue until the Registrant has been re-assessed by his treating physician and the physician provides a medical report to ARNNL confirming the Respondent’s fitness to return to the practice of nursing. After providing proof of medical fitness, the Respondent’s license shall be restricted in that he is not permitted to administer any medication, work in any setting where he has access to medications, or practice nursing more than 40 hours in a seven day period.

The Respondent is also required to comply with the following conditions:
(i) Provide proof of: random drug screens, participation in treatment and counseling, attendance at a self-help program, notification of his employer(s) regarding the Order of the Adjudication Tribunal;

(ii) Abstain from the use of mood altering medications unless prescribed;

(iii) Withdraw immediately from nursing practice and surrender his license in case of a relapse.

The Respondent may apply to the Adjudication Tribunal to vary the restrictions on his license after five years. Failure to comply with any of the conditions shall result in suspension of his license pending a hearing.

There was no Order as to costs.


Margo Bishop (Edwards)
Newfoundland and Labrador Registration No. 17623
In the matter of a Complaint against Margo Bishop (Edwards) (the “Respondent”), ARNNL # 17623, and a hearing of the Complaint pursuant to Section 25 of the Registered Nurses Act, 2008 (the “Act”); an Adjudication Tribunal of the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) in a Decision dated February 11, 2011 found the Respondent guilty of conduct deserving of sanction pursuant to the Act, in particular, the following sections:

18 (c) (i) Professional misconduct, in that the Respondent gently kicked a client in the buttocks;

18 (c) (i) Professional misconduct and 18 (c) (v) acting in breach of the Act and Code of Ethics, in that the Respondent proceeded to provide care to a patient after she was informed that the family did not wish to have her care for the family member and approached the family with regards to this issue;

18 (c) (ii) Professional incompetence, in that the Respondent failed to meet proper medication standards, documentation standards and organization policies for safe medication administration;

18 (c) (iii) Conduct unbecoming a registered nurse and 18 (c) (iv) incapacity or unfitness to engage in the practice of nursing, as demonstrated by the Respondent’s behaviour (examples include repeatedly cutting her hair during a shift, refusing to pass keys over to relief nurses when going on break, napping during the day and having to be woken and having to be called three times one night to get up) and the Respondent’s nursing practice with respect to the administration and documentation of narcotics.

The conduct deserving of sanction occurred during the period of November 26, 2008 to March 5, 2009 while the Respondent practiced in St. Lawrence, Newfoundland and Labrador. The Complainant was Eastern Health.

Pursuant to section 28(3) of the Act, the Adjudication Tribunal ordered suspension of the Respondent’s license for two years effective from October 26, 2010. The Respondent is required to immediately enter a treatment program for substance abuse unless not recommended to do so by a physician or health care provider. Following the period of suspension the Respondent is prohibited from acquiring a license to practice nursing in the Province of Newfoundland and Labrador until the following terms and conditions are met to the satisfaction of the ARNNL:

(i) supportive assessments regarding her medical and health status with respect to her ability to return to the active practice of nursing;

(ii) satisfactory completion of a Nursing Re-entry program, if required, based on the outcomes of the medical assessments; and

(iii) qualify for registration and licensing pursuant to the Act.

Upon reinstatement of a practicing license the Respondent is required to comply with the following terms:
(i) maintain a primary attending physician and/or clinical addictions therapist reasonably knowledgeable in the area of addictions medicine as approved by ARNNL, which physician and/ or clinical addictions therapist shall provide reports to ARNNL;

(ii) comply with conditions to include: advising ARNNL of any nursing employer she obtains, providing a copy of the Order of the Adjudication Tribunal to her nursing employer(s), ensuring she has no personal access to or the administration of narcotics and any controlled substances, submitting to random drug screens, participating in a self-help group;

(iii) refrain from the use of any medication or controlled substances unless prescribed;

(iv) complete an education program satisfactory to ARNNL which includes medication administration, nursing assessment and documentation.

A breach of any conditions as ordered by the Adjudication Tribunal shall be deemed an act of professional misconduct and may result in the ARNNL suspending the Respondent’s license pending a disciplinary hearing. The terms of the Order remain in effect for a period of five years after the Respondent’s license is reinstated and may be renewed as deemed appropriate by ARNNL.

There was no Order as to costs.


Jennifer Abbott
Newfoundland and Labrador Registration No. 17045
Pursuant to a hearing held in accordance with Section 25 of the Registered Nurses Act (2008) (the “Act”) on September 29, 30 and October 1, 2010, the Adjudication Tribunal found Jennifer Abbott (the “Respondent”) guilty of conduct deserving of sanction pursuant to Act, in particular, section 18(c):

(i) Professional misconduct, in that the Respondent failed on several occasions to follow instructions of her supervisor or preceptor and as well confronted a family member of a palliative care patient in an inappropriate manner;

(ii) Professional incompetence, in that the Respondent breached the standards of care to be expected of a competent nurse, including breakdowns and errors during all aspects of the nursing process; and

(iii) Conduct unbecoming a registered nurse, in that the Respondent consistently violated her employer’s and her profession’s expectations of reporting to work on time.

The conduct occurred during the period of December 5, 2008 to April 23, 2009 while the Respondent practiced in Buchans and Gander, Newfoundland and Labrador.

Pursuant to section 28(3) of the Act, the Adjudication Tribunal ordered that the Respondent is prohibited from acquiring a license to practice nursing in the Province of Newfoundland and Labrador until the following terms and conditions are met to the satisfaction of the ARNNL Director of Regulatory Services:

(i) supportive assessments regarding her medical and functional ability to practice as a registered nurse,

(ii) satisfactory completion of a Nursing Re-entry program, if required, based on the outcomes of the medical assessments, and

(iii) qualify for registration and licensing pursuant to the Act.

There was no Order as to costs.


Fay Wheeler (Compagnon)
Newfoundland and Labrador Registration No. 6894
On December 7, 2010, the ARNNL Council suspended the practicing license of Fay Wheeler pending decision of the disciplinary panel.


Judith Watton 
Newfoundland and Labrador Registration No. 9265
Pursuant to a hearing held in accordance with Section 25 of the Registered Nurses Act (2008) (the “Act”) on March 10 and 11, 2010, the Adjudication Tribunal found Judith Watton in breach of Section 18 (c ) (i) professional misconduct and (ii) professional incompetence, of the Act.

The Adjudication Tribunal ordered that the Registrant shall not be eligible to have her license to practice nursing re-instated until she has successfully completed an Education Re-Entry to Practice Nursing Program and post RN, BN Health Assessment, Pathophysiology and Pharmacology courses from an accredited Canadian School of Nursing or other post–secondary education institution. Official course transcripts must be submitted to the ARNNL Director of Regulatory Services before the Respondent’s license is considered for reinstatement. The Adjudication Tribunal further ordered that the Respondent pay a portion of the costs incurred by the ARNNL in the investigation and hearing of the Complaint.


Sybil Maynard
Newfoundland Registration No. 13136
On March 18, 2010, the practicing license of Ms. Maynard was suspended in accordance with the Order of the Professional Conduct Review (PCR) Panel of the ARNNL Discipline/Professional Conduct Review Panel, dated May 8, 2008. Ms. Maynard’s license will remain suspended until the conditions of the Order are met.


Fay (Compagnon) Wheeler
Newfoundland and Labrador Registration No. 6894
Pursuant to a hearing held in accordance with Section 25 of the Registered Nurses Act (2008) (the “Act”) on June 26, 2009, the Adjudication Tribunal found Fay Wheeler in breach of Section 18 (c ) (iii) conduct unbecoming a registered nurse, of the Act.

The Adjudication Tribunal ordered conditions for the Registrant to comply with, and the Tribunal confirmed that the Order of the Professional Conduct Review Panel rendered March 13, 2008 with respect to the Registrant is still in full force and effect except where so modified by the present Order.


Chastity Buglar
Newfoundland and Labrador Registration No. 19482
As a result of a hearing held on April 7 and 8, 2009 Chastity Buglar was found in breach on Section 18 (c) (ii) professional incompetence, of the Registered Nurses Act (2008).

The Adjudication Tribunal who oversaw the hearing ordered the Registrant to surrender any current license in her possession to the Council and further directed the Council to strike the Registrant's name from the Register, pursuant to Section 28 (3) (c) of the Act.

Chastity Buglar no longer holds a license to practice as a registered nurse with ARNNL.


Sybil Maynard
Newfoundland and Labrador Registration No. 13136
On October 16, 2009 the practicing license of Sybil Maynard was reinstated with conditions.

As a result of a hearing held on April 22, 2008 Sybil Maynard was found in breach of Sections 21 2 (b) incompetence and 2(d) conduct that does not conform to the standards of the profession, of the Registered Nurses Act.

The Panel who oversaw the hearing ordered suspension of ARNNL Registration for Sybil Maynard, Registration # 13136, pending completion of conditions.


Fay Wheeler (Compagnon)
Newfoundland and Labrador Registration No. 6894
As a result of a hearing held on March 12 & 13, 2008 Fay Wheeler was found in breach of Sections 21 2 (b) incompetence and 2(d) conduct that does not conform to the standards of the profession, of the Registered Nurses Act.

The Panel who oversaw the hearing ordered suspension of ARNNL Registration for Fay Wheeler, #6894 , until she has completed a nursing re-entry program. During the period in which the Registrant's License to Practice Nursing is suspended, the registrant is not to practice nursing in another jurisdiction. Following completion of the program a practicing license will be issued with conditions.

On September 3, 2009, the practicing license of Fay Wheeler was reinstated with conditions.


Elizabeth Marie Power (Young)
Newfoundland and Labrador Registration No. 12388
As a result of a hearing held on March 7, 2007 Elizabeth Power was found in breach of Sections 21 2 (b) incompetence and 2(d) conduct that does not conform to the standards of the profession, of the Registered Nurses Act.

The Panel who oversaw the hearing ordered that the registration of Elizabeth Power #12388 be suspended until she has completed a nursing re-entry program. Upon completion of the program a practicing license will be issued with conditions.


Elizabeth Marie Power (Young)
Newfoundland and Labrador Registration No. 12388
On December 4, 2009 Elizabeth Power met the terms of the Order of the Professional Conduct Review Panel rendered on March 7, 2007 such that her practicing license was reinstated with conditions.

On December 17, 2010 Elizabeth Power met the terms of the Order of the Professional Conduct Review Panel dated April 9, 2007 such that there are no longer conditions on her practicing license with ARNNL.


Terrance Harvey
Newfoundland and Labrador Registration No. 14507
As a result of a hearing held on October 18, 2006, Terrance Harvey was found to be in breach of Sections 21 (2)(a) dishonesty and (2)(c) a habit or illness making the nurse unfit to care for the sick, and 21 (2)(d) conduct that does not conform to the standards of the profession, of the Registration Nurses Act.

The Panel who oversaw the hearing ordered that the registration of Terrance Harvey #14507 be revoked effective immediately.


Mary Sloan
Newfoundland and Labrador Registration No. 5885
As a result of a hearing held on December 21, 2006 Mary Sloan was found in breach of Section 21 2(d) conduct that does not conform to the standards of the profession, of the Registered Nurses Act.

The Panel who oversaw the hearing ordered that the registration of Mary Sloan #5885 be suspended for a period of three months; form January 2, 2007 to April 2, 2007. The panel also ordered that during this period Mary Sloan is not to practice nursing in another jurisdiction.


Mary Margaret Sloan
Newfoundland and Labrador Registration No. 05885
On January 9, 2006, the Professional Conduct Review (PCR) Panel of the Discipline/PCR Committee found Mary Margaret Sloan, ARNNL Registration No. 05885, was in breach of Sections 21 (2) (b) and (2) (d) of the Registered Nurses Act.

The Panel ordered that the Registrant's license be suspended for three months and that there are conditions to be fulfilled prior to the license being released.


Pamela Angel (Noseworthy)
Newfoundland and Labrador Registration No. 6969
As a result of a hearing held on August 1, 2005 Pamela Angel was found to be in breach of Sections 21 (2)(b) incompetence and (2)(d) conduct that does not conform to the standards of the profession of the Registered Nurses Act.

The Panel who oversaw the hearing ordered that Pamela Angel #6969 shall not be eligible for a practicing license until she has completed a nursing re-entry program.


Carolyn Gamal Eldin (Colbourne)
Newfoundland and Labrador Registration No. 14166
As a result of a hearing held on July 18, 2005 Carolyn Gamal Eldin was found to be in breach of Sections 21 (2)(a) dishonesty and (2)(d) conduct that does not conform to the standards of the profession of the Registered Nurses Act.

The Panel who oversaw the hearing ordered that the registration of Carolyn Gamal Eldin # 14166 be revoked effective immediately.


Beverly Farrell (LaFosse)
Newfoundland and Registration No. 16863
On 26 March 2004, the Disciplinary Panel of the Discipline Committee found that Beverly Farrell in breach of Sections 21 (2)(a) dishonesty, and (2)(d) conduct that does not conform to the standards of the profession, of the Registered Nurses Act.

The decision of the panel is revocation of her license to practice nursing.


Victoria Morris (Daniel)
Newfoundland and Labrador Registration No. 11488
On 4 January 2002, the Disciplinary Panel of the Discipline Committee found Victoria Morris in breach of Sections 21 (2)(a) dishonesty, and (2)(b) incompetence, of the Registered Nurses Act.

The Panel suspended her license for 3 months for the offense of dishonesty and 18 months for the offense of incompetence, the suspensions to run concurrently commending January 16, 2002. The Panel, in addition to the suspension, imposed conditions to be met before the license is reinstated. The license will be reinstated after the suspension period providing the conditions imposed by the Panel have been met.

In that the nurse has failed to meet the conditions for reinstatement of her license during the suspension period, in accordance with the Disciplinary Panel decision, we advise you that effective August 1, 2003 her license to practice nursing has been revoked.


Marilyn D. Walsh (nee Motty)
Newfoundland and Labrador Registration No. 12059
On 3 May 2001, Ms. Walsh agreed she was in breach of Sections 21 (2)(b) incompetence, and (2)(d) conduct that does not conform to the standards of the profession or is unbecoming to a nurse, of the Registered Nurses Act.

The Disciplinary Panel accepted a joint submission by the ARNNL and the Registrant on discipline and penalty.

The Panel suspended her license indefinitely with conditions effective May 3, 2001. The license will be reinstated when the conditions have been met.


Susan Patricia O'Keefe
Newfoundland and Labrador Registration No. 16600
On 06 March 2000, a Disciplinary Panel of the Discipline Committee of the Association of Registered Nurses of Newfoundland and Labrador (ARNNL) accepted an agreed statement of fact in which Ms. O'Keefe acknowledged that due to misuse of a medication, she was unfit to practice nursing during a scheduled work shift but did continue to work. The Panel in accepting the statement of fact noted the behaviour was in contravention of ARNNL Standards of Practice.

The Panel, having considered the incident, suspended her license for one month with conditions effective 07 March 2000. The license will be reinstated at the end of the suspension period if the conditions have been met.

On 07 April 2000, the practicing license of Susan Patricia O'Keefe previously suspended, was reinstated.


Mary Margaret Sloan
Newfoundland and Labrador Registration No. 05885
On 14 July 1999, the Disciplinary Committee found Mary Margaret Sloan, ARNNL Registration No. 05885, was in violation of Section 21 (2) (a) of the Registered Nurses Act, in that the Registrant was guilty of dishonesty. Her dishonesty and failure to be accountable and assume responsibilities for her actions are breaches of the Code of Ethics and ARNNL Standards 4.2, 4.3 and 6.1 and is conduct unbecoming to a nurse.

The Committee, having considered all of the evidence, suspended her license for two (2) months with a condition effective 9 August 1999. The license will be reinstated at the end of the suspension period if the condition has been met.

On 09 October 1999, the practicing license of Mary Margaret Sloan previously suspended, was reinstated.
